In these terms and conditions:

‘Contract’ means any contract between us and you for the sale and purchase of the Goods, incorporating these Terms and Conditions.

‘the Goods’ means the goods in your shopping basket at the time of ordering. It includes any service that comes with those goods.

If you use our website, this indicates that you accept these terms and conditions irrespective of whether you buy from us.

‘Seller’ means The Café Cake Company, a trading name of The Nut House Ltd. Unit D, 17 Towcester Road, London, E3 3ND. Contact us at sales@thecafecakecompany.co.uk

‘we’, ‘us’, ‘our’ means The Café Cake Company.

‘working day’ means every day of the year except weekends, and UK statutory and public holidays.

‘you’ or ‘your’ means you as one of our customers ordering goods subject to these terms and conditions.


These terms and conditions and our contract with you are governed by and construed in all respects in accordance with the laws and courts of England and no other. All disputes shall be subject to the exclusive jurisdiction of the courts of England. Your statutory rights are unaffected.

If any provision contained in these Terms and Conditions is judged by an English court or UK regulatory authority to be unfair, invalid or unenforceable, this will not affect the validity and enforceability of the remaining provisions.

All orders will be subject to these terms and conditions.

The terms and conditions cannot be varied by you or The Café Cake Company unless made in writing and signed by both parties.

Product Information

Product information, photographs and dietary indicators which may be contained on the www.thecafecakecompany.co.uk website or on point-of-sale material are provided for information purposes only and are not intended to constitute medical advice. It is not a substitute for advice given by your doctor or other medical professional. Products contain eggs, wheat flour, milk proteins and may contain soya, nuts and traces of other nuts including peanuts.

If you have any questions or concerns regarding a medical condition, particularly if there is a possibility of an allergic reaction please consult your doctor. Ingredients may change from time to time and you should always check the details on the pack prior to using the product.

The website may contain typographical or technical errors and we make no representations or warranties as to the accuracy of information on the website. You agree to indemnify us and hold us harmless from any claims, actions or demands resulting from ordering or consuming any goods ordered from us.

All products sold on this website are packed in an environment containing nut products. As all goods are hand finished there may be a slight variation in the finished product appearance. If you have an enquiry about ingredients please call us prior to ordering.

Promotions and Offers

From time to time The Cafe Cake Company may introduce special promotions and offers. They may not be open to everyone and may be withdrawn without notice.

Any promotional claims of savings, value, return on investment, etc are purely illustrative and may not apply to every customer depending on individual circumstances.

Order Processing and Payment

You must open an account with The Cafe Cake Company to place an order.

A contract does not exist between us until we email an order confirmation confirming that your order has been received and payment made to us. When your order is accepted, a confirmation will be sent to the email or postal address you provided when placing your order. At this point your order becomes binding and may only be cancelled as detailed below. As our order confirmation is generated automatically we reserve the right to cancel the order should the confirmation contain an error. In this unlikely event we will contact you as soon as possible.

If a product is out of stock we will process the remaining products on your order and deliver your order to you as soon as possible. If you prefer us to delay your delivery until all of your order is in stock please tell us when you place the order.

Please note that we cannot accept your order until you have paid for it in full. When payment has been made we will confirm acceptance of your order by email. Online payment can be made usingPaypal, Master Card, Visa, American Express, Switch, Delta, Maestro cards. Offline payment can be made by cheque or postal order. All cheques should be made payable to The Nut House Limited with the cheque guarantee card number on the reverse. No goods will be despatched until credit or debit cards or cheque transactions have been authorised and payment received. Where appropriate, delivery will be charged in addition and the additional charge displayed at the check out. All prices shown on this website are inclusive of VAT where applicable. Delivery charges will be added at checkout. VAT invoices are dispatched with your goods.


We will endeavour to deliver within 3 working days all orders placed by 10am. Orders placed after 10am may take up to 4 working days for delivery. Free delivery offers only apply to addresses in England and Wales, orders from Scotland, Northern Ireland, Ireland and the Channel Islands incur an excess carriage charge of £14.99. Overseas deliveries will need to be quoted on an order by order basis. International orders are generally received in under 14 days. We cannot give a guarantee as to exact time and date and time is not of the essence for this reason.

You are responsible for entering accurate details of name, address and post code for the delivery address. We do not take responsibility for mis-delivered orders due to incorrect or incomplete information supplied by you.

We cannot deliver on weekends or UK bank holidays. Deliveries to large institutions with multiple departments will only be made to a main reception address. We do not deliver to PO boxes.

Irrespective of any other provisions in these terms and conditions we will not be liable for any loss, including loss of profit, costs or damages caused by any delay in the delivery of the goods, howsoever caused.

In the event of us or our courier being unable to deliver due to force majeure, not restricted to flood, fire, explosion, mechanical and electrical breakdown, industrial action, riot, act of government, act of war or act of God, we shall not be liable for any failure to deliver the goods.

You must inform us, quoting your order number, within two working days of receipt of the order if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem.

Returns and Cancellations

The Nut House will refund your purchase if for you are not happy with your order. If you wish to cancel your orderplease contact us within 2 working days of purchase by calling  0207 719 8782 or use our contact form Claims for breakages must also be made within 2 days in order that we may make a timely claim to the delivery company. We may offer you an exchange or refund.Due to the perishable nature of the goods we will collect the goods free of charge if the goods are faulty but if you have changed your mind we will deduct the cost of collection charges from your refund.This does not affect your statutory rights under the EU Distance Selling Directive.
